INDIANAPOLIS, IN– The Indiana Supreme Court’s ruled 3 to 2 not to reconsider its ruling that overturned former state trooper David Camm’s 2 convictions for the murders of his family back in 2000.
Camm’s wife Kim, their son Brad, and their daughter Jill, were all shot to death in the family SUV, in their Georgetown garage.
The justices voted Monday to deny the attorney general’s request for a rehearing of Camm’s appeal. That could set the stage for a 3rd murder trial for the twice-convicted inmate.
The court ruled 4-1 in June of this year, that prosecutor Keith Henderson improperly inflamed the jury in Camm’s last trial, arguing without evidence that Camm had molested his daughter. Henderson maintains that was an “argument” based on inference, rather than “evidence” based on fact.
The 45-year-old Camm remains in prison awaiting a decision on whether he’ll again face a new trial. Henderson says he’ll decide whether to prosecute him again, within days.
